Privacy Policy Introduction

Simply Arden respects the privacy of it’s visitors. This Privacy Policy is intended to explain how Simply Arden collects, uses, discloses, and safeguards visitor information when they visit Simply Arden, including any other media form, media channel, mobile website, or mobile application related or connected to Simply Arden.

Please read this Privacy Policy carefully. If visitors do not agree with the terms of this Privacy Policy, please do not access Simply Arden.

Simply Arden reserves the right to make changes to this Privacy Policy at any time and for any reason. Simply Arden will alert visitors about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy, and visitors waive the right to receive specific notice of each such change or modification.

Visitors are encouraged to periodically review this Privacy Policy to stay informed of updates. Visitors will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by a visitor’s continued use of Simply Arden after the date such revised Privacy Policy is posted.


Collection of Visitor Data

Simply Arden may collect information about visitors in a variety of ways. The information collected may include:

Personal Data

Personally identifiable information, such as a visitor’s name, shipping address, email address, telephone number, demographic information, such as a visitor’s age, gender, hometown, and interests, that a visitor voluntarily gives to Simply Arden (when a visitor registers with Simply Arden (or the mobile application,) or when a visitor chooses to participate in various activities related to Simply Arden (and the mobile application), such as online chat and message boards. Visitor’s are under no obligation to provide Simply Arden with personal information of any kind, however a visitor’s refusal to do so may prevent a visitor from using certain features of Simply Arden (and the mobile application).

Derivative Data

Information that Simply Arden’s servers automatically collects when visitor’s access Simply Arden, such as a visitor’s IP address, browser type, operating system, access times, and the pages a visitor has viewed directly before and after accessing Simply Arden. (If a visitor is using the mobile application, this information may also include a visitor’s device name and type, operating system, phone number, country, likes and replies to a post, and other interactions with the application and other visitor’s via server log files, as well as any other information a visitor chooses to provide).

Comments and Contact Forms

Information is collected when visitors leave comments or fill out contact forms on Simply Arden, such as the data shown in the comments and/or contact form(s); but this may also include the visitor’s IP address, access times, and the browser user agent string to help spam detection.

An anonymized string created from a visitor’s email address (also called a hash) may be provided to the Gravatar service to see if visitors are using it. Please read the Gravatar service privacy policy. After approval of a visitor’s comment, the Gravatar profile picture is visible to the public in the context of the comment.

Book and Recipe Reviews

When a visitor leaves a review on Simply Arden, Simply Arden will store the visitor’s name, email address, IP address, review text and review rating. Simply Arden may chose to share a visitor’s review text, review rating, and name with Google for the express purpose of enabling Structured Data markup for Simply Arden’s reviews on their search result pages.

Cookies

If a visitor leaves a comment on Simply Arden, they may opt-in to saving their name, email address, and website in cookies. These are for a visitor’s convenience so that they do not have to fill in these details again when leaving another comment. These cookies will last for one year.

When users visit the Simply Arden login page, it will set a temporary cookie to determine if a visitor’s browser accepts cookies. This cookie contains no personal data and is discarded when a visitor closes their browser.

When a visitor logs in, Simply Arden will also set up several cookies to save the login information and the screen display choices. Login cookies last for up to two weeks, and screen options cookies last for a year. If a visitor selects “Remember Me”, the login will persist for two weeks. If a visitor logs out of their account, the login cookies are removed.

If a visitor edits or publishes an article, an additional cookie will be saved in their browser. This cookie includes no personal data and simply indicates the post ID of the article that was edited. It expires after one day.

Third-Party and Embedded Data

Articles (pages/posts/etc) on Simply Arden may include embedded or third-party content (e.g. videos, images, articles, links, etc.). Embedded and third-party content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about a visitor, use cookies, embed additional third-party tracking, and monitor a visitor’s interaction with that embedded content, including tracking a visitor’s interaction with the embedded content if a visitor has an account and is logged in to that website (for example, Spotify).

Analytics

Simply Arden uses WordPress and Google Analytics to collect information about how Simply Arden is used. These companies collect information such as how often visitors view Simply Arden, which pages, how often, and at what times, and what other sites a visitor used before and after accessing Simply Arden. These companies collect a visitor’s IP address and use cookies (see section “Cookies”) and no other unique identifiable data.

Only WordPress and Google’s Analytics has the ability to use and share information collected by them about a visitor’s visits to Simply Arden, and is restricted by the Google Analytics Terms of Use and the Google privacy policy. Visitors can prevent Google Analytics from recognizing them on return visits to Simply Arden by disabling cookies.

Simply Arden uses this information to improve the website and to give visitors a better experience.

Social Media Data

Visitor information from social networking sites, such as Apple’s Game Center, Facebook, Goodreads, Google+, Instagram, Pinterest, Twitter, YouTube, etc., including a visitor’s name, social network username, location, gender, birth date, email address, profile picture, and public data for contacts, if a visitor connects their account to such social networks. If a visitor is using the mobile application, this information may also include the contact information of anyone a visitor invites to use and/or join the mobile application.

Facebook Permissions

Simply Arden (and the mobile application) may by default access a visitor’s Facebook basic account information, including name, email, gender, birthday, current city, and profile picture URL, as well as other information that a visitor chooses to make public. Simply Arden may also request access to other permissions related to a visitor’s account, such as friends, checkins, and likes, and a visitor may choose to grant or deny Simply Arden access to each individual permission. Financial Data

Financial information, such as data related to a visitor’s payment method (e.g. credit card number, card brand, and expiration date) that Simply Arden may collect when a visitor purchases, orders, returns, exchanges, or requests information about Simply Arden’s services from Simply Arden (or the mobile application). Simply Arden stores only very limited, if any, financial information that is collected. Otherwise, all financial information is stored by Simply Arden’s payment processor(s), and visitors are encouraged to review their privacy policies and contact them directly for responses to any questions.

Media

If a visitor uploads images to Simply Arden, visitors should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to Simply Arden can download and extract any location data from such images.

Mobile Device Data

Device information, such as a visitor’s mobile device ID, model, and manufacturer, and information about the location of visitor’s device, if a visitor accesses Simply Arden from a mobile device.

  • Geo-Location Information – Simply Arden may request access or permission to and track location-based information from a visitor’s mobile device, either continuously or while a visitor is using the mobile application, to provide location-based services. If a visitor wishes to change Simply Arden’s access or permissions, they may do so in their device’s settings.
  • Mobile Device Access – Simply Arden may request access or permission to certain features from a visitor’s mobile device, including the mobile device’s bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage, and other features. If a visitor wishes to change Simply Arden’s access or permissions, they may do so in their device’s settings.
  • Mobile Device Data –  Simply Arden may collect device information such as a visitor’s mobile device ID, model and manufacturer, operating system, version information, and IP address.
  • Push Notifications – Simply Arden may request to send visitors push notifications regarding a visitor’s account or the application. If a visitor wishes to opt-out from receiving these types of communications, they may turn them off in their device’s settings.

Use of Visitor Information

Having accurate information about visitors permits Simply Arden to provide visitors with a smooth, efficient, and customized experience. Specifically, Simply Arden may use information collected about visitors via Simply Arden (or the mobile application) to:

  • Administer sweepstakes, promotions, and contests.
  • Assist law enforcement and respond to subpoena.
  • Compile anonymous statistical data and analysis for use internally or with third parties.
  • Create and manage visitor accounts.
  • Deliver targeted advertising, coupons, newsletters, and other information regarding promotions and Simply Arden (and the mobile application).
  • Email visitors regarding their account or order.
  • Enable user-to-user communications.
  • Fulfill and manage purchases, orders, payments, and other transactions related to Simply Arden (and the mobile application).
  • Generate a personal profile about a visitor to make future visits to Simply Arden (and the mobile application) more personalized.
  • Increase the efficiency and operation of Simply Arden (and the mobile application).
  • Monitor and analyze usage and trends to improve visitor experience with Simply Arden (and the mobile application).
  • Notify visitors of updates to Simply Arden (and the mobile application).
  • Offer new products, services, mobile applications, and/or recommendations.
  • Perform other business activities as needed.
  • Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.

  • Request feedback and contact visitors about use of Simply Arden (and the mobile application).

  • Solicit support for Simply Arden (and the mobile application).

Data Retention

If visitors leave a comment, the comment and its metadata are retained indefinitely. This is so Simply Arden can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For visitors that register on Simply Arden (if any), Simply Arden also stores the personal information they provide in their user profile indefinitely. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit this information.

Data Rights

If a visitor has an account on Simply Arden, or has left comments, a visitor can request to receive an exported file of the personal data held, including any data the visitor has provided to Simply Arden. Visitors can also request that Simply Arden erase any personal data held. This does not include any data Simply Arden is obliged to keep for administrative, legal, or security purposes.

Sent Data

Visitor comments are checked through an automated spam detection service. Simply Arden collects information about visitors who comment on Simply Arden using the Akismet anti-spam service. The information Simply Arden collects depends, but typically includes the commenter’s IP address, user agent, referrer, and the Simply Arden URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

Visitor Information Disclosure

Simply Arden may share information Simply Arden has collected about visitors in certain situations. A visitor’s information may be disclosed as follows:

By Law or to Protect Rights

If Simply Arden believes the release of information about a visitor is necessary to respond to legal process, to investigate or remedy potential violations of Simply Arden’s policies, or to protect the rights, property, and safety of others, Simply Arden may share visitor information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

Affiliates

Simply Arden may share a visitor’s information with affiliates, in which case Simply Arden will require those affiliates to honor this Privacy Policy. Affiliates include any parent company and any subsidiaries, joint venture partners or other companies that Simply Arden controls or that are under common control with Simply Arden.

Marketing Communications

With a visitor’s consent, or with an opportunity for a visitor to withdraw consent, Simply Arden may share a visitor’s information with third parties for marketing purposes, as permitted by law.

Business Partners

Simply Arden may share a visitor’s information with business partners to offer certain products, services, or promotions.

Social Media Contacts

If a visitor connects to Simply Arden (or the mobile application) through a social network, contacts on the social network will see a visitor’s name, profile photo, and descriptions of the visitor’s activity.

Interactions with Other Users

If a visitor interacts with other users of Simply Arden (and the mobile application), those users may see a visitor’s name, profile photo, and descriptions of the visitors activity, including sending invitations to other users, chatting with other users, liking posts, and following blogs.

Online Postings

When a visitor post comments, contributions, or other content to Simply Arden (or the mobile applications), the visitor’s posts may be viewed by all users and may be publicly distributed outside Simply Arden (and the mobile application) in perpetuity.

Third-Party Advertisers

Simply Arden may use third-party advertising companies to serve ads when a visitor views Simply Arden (or the mobile application). These companies may use information about a visitor’s visits to Simply Arden (and the mobile application) and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to visitors.

Third-Party Data Receipt

Simply Arden does not receive any data from third-parties.

Third-Party Service Providers

Simply Arden may share visitor information with third parties that perform services for Simply Arden or on Simply Arden’s behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

Other Third Parties

Sale or Bankruptcy

If Simply Arden goes out of business or enters bankruptcy, visitor information would be an asset transferred or acquired by a third party. Visitors acknowledge that such transfers may occur and that the transferee may decline honoring commitments Simply Arden made in this Privacy Policy.

Simply Arden is not responsible for the actions of third parties with whom visitors share personal or sensitive data, and Simply Arden has no authority to manage or control third-party solicitations. If visitors no longer wish to receive correspondence, emails, or other communications from third parties, visitors are responsible for contacting the third party directly.


Tracking Technologies

Cookies and Web Beacons

Simply Arden may use cookies, web beacons, tracking pixels, and other tracking technologies on Simply Arden (and the mobile application) to help customize Simply Arden (and the mobile application) and improve visitor experience. Most browsers are set to accept cookies by default. Visitor’s can remove or reject cookies, but be aware that such action could affect the availability and functionality of Simply Arden (and the mobile application). Visitors may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying a web browser’s settings to notify visitors each time a cookie is tendered, permitting them to accept or decline cookies on an individual basis.

Internet-Based Advertising

Additionally, Simply Arden may use third-party software to serve ads on Simply Arden (and the mobile application), implement email marketing campaigns, and manage other interactive marketing initiatives. This third-party software may use cookies or similar tracking technology to help manage and optimize a visitor’s online experience with Simply Arden. Website Analytics

Simply Arden may also partner with selected third-party vendors, to allow tracking technologies and re-marketing services on Simply Arden (and the mobile application) through the use of first-party cookies and third-party cookies, to, among other things, analyze and track a visitor’s use of Simply Arden (and the mobile application), determine the popularity of certain content and better understand online activity. By accessing Simply Arden (and the mobile application), visitors consent to the collection and use of information by these vendors.

Visitors are encouraged to review their privacy policy and contact them directly for responses to any questions. Simply Arden does not transfer personal information to these vendors. However, if visitors do not want any information to be collected and used by tracking technologies, they can visit the vendor or the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool.

Simply Arden (and the mobile application) may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with Simply Arden. Once visitors have used these links to leave Simply Arden (and the mobile application), any information a visitor provides to these third parties is not covered by this Privacy Policy, and Simply Arden cannot guarantee the safety and privacy of a visitor’s information.

Before visiting and providing any information to any third-party websites, visitors should inform themselves of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in their discretion, protect the privacy of their information. Simply Arden is not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from Simply Arden (and the mobile application).


Visitor Information Security and Protection

Simply Arden uses administrative, technical, and physical security measures to help protect visitor’s personal information. While Simply Arden has taken reasonable steps to secure the personal information visitors provide to Simply Arden, please be aware that despite Simply Arden efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, Simply Arden cannot guarantee complete security if visitors provide personal information.

Data Breach Procedures

If at any time a data breach is identified on Simply Arden, please be aware that Simply Arden handles and stores visitor personal data as securely as possible. Simply Arden is committed to making reasonable security arrangements to protect visitor data and to prevent any unauthorized access, collection, use, disclosure, or similar risks. A data breach generally refers to the unauthorized access and retrieval of information that may include a visitor’s personal data. 

Simply Arden has the following procedures in place if a data breach were ever to occur:

  • Monitoring and notification for early data breach detection.
  • Staff is trained in latest internet security measures and protocols.
  • Immediately confirm and contain the breach.
  • Report the breach to the affected visitors and third-parties.
  • Report the breach to the appropriate authorities and provide any necessary follow-up information needed for any investigation or inquiry.
  • Evaluate the breach and provide and implement any additional security training, measures, and improvements.

Security and Protection Policy for Children

Simply Arden does not knowingly solicit information from or market to children under the age of 13. If a visitor becomes aware of any data Simply Arden has collected from children under age 13, please contact Simply Arden using the contact information provided below.

Controls for Do-No-Track Features

Most web browsers and some mobile operating systems (and the mobile applications) include a Do-Not-Track (“DNT”) feature or setting that visitors can activate to signal their privacy preference not to have data about their online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, Simply Arden does not currently respond to DNT browser signals or any other mechanism that automatically communicates a visitor’s choice not to be tracked online.

If a standard for online tracking is adopted that Simply Arden must follow in the future, Simply Arden will inform visitors about that practice in a revised version of this Privacy Policy.


Visitor Information Options

Account Information

Visitors may at any time review or change the information in their account or terminate their account by:

  • Logging into the account settings and updating their account;
  • Contacting Simply Arden using the contact information provided below.

Upon a visitor’s request to terminate their account, Simply Arden will deactivate or delete the account and information from the active databases. However, some information may be retained in Simply Arden’s files to prevent fraud, troubleshoot problems, assist with any investigations, enforce the Terms of Use and/or comply with legal requirements.

Emails and Communications

If a visitor no longer wishes to receive correspondence, emails, or other communications from Simply Arden, they may opt-out by:

  • Noting their preferences at the time they register their account with Simply Arden (and the mobile application);
  • Logging into the account settings and updating their preferences;

California Privacy Rights

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits Simply Arden’s users who are California residents to request and obtain from Simply Arden, once a year and free of charge, information about categories of personal information (if any) Simply Arden disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which Simply Arden shared personal information in the immediately preceding calendar year. If visitors are a California resident and would like to make such a request, please submit the request to Simply Arden using the contact information provided below.

If visitors are under 18 years of age, reside in California, and have a registered account with Simply Arden (and the mobile application), visitors have the right to request removal of unwanted data that the visitor publicly posts on Simply Arden (and the mobile application). To request removal of such data, please contact Simply Arden using the contact information provided below, and include the email address associated with said account and a statement that the visitor resides in California. Simply Arden will ensure the data is not publicly displayed on Simply Arden (and the mobile application), but please be aware that the data may not be completely or comprehensively removed from Simply Arden’s systems.
